SayHey Messenger® Privacy Policy

This Privacy Policy applies to all users using SayHey services. If you do not agree with this  Privacy Policy please do not use our services and do not send any personal data to us. Note:  this Privacy Policy does not apply to any third party applications with which you may use the  SayHey services. Terms not defined in this Privacy Policy are defined in the Terms of Service  (the “Terms”). 

Your privacy is important to us. This policy addresses our privacy practices with respect to (i) the  personal information provided by users of our website https://www.sayheymessenger.co/ and any  subdomains or other websites or pages where this Privacy Policy is linked, or where you access  the SayHey services; (ii) the way we use personal information internally; and (iii) our policy  regarding sharing your personal information with others. 

For purposes of this Privacy Policy, “Personal Information” means any information that, by itself  or in combination with other information, identifies or can reasonably be used to identify an  individual, such as name, email address, IP address, telephone number, address, billing  information or date of birth. Personal Information does not include information that is anonymized,  or publicly available information. The term “Processing” means any operation or set of operations  which is performed on Personal Information, whether or not by automated means, such as  collection, use, organization, storage, alteration or destruction, disclosure, or transfer.

This policy does not apply to information received from third-parties or third party websites,  applications or software that may work with the Site or Application. Customers are responsible for  their own privacy and security practices, which may differ. The company entering into the  agreement with 7T for the SayHey Subscription controls the settings for its instance of the SayHey  environment that Users may access. The is the only privacy policy that applies to SayHey.  

1 What we collect and how we collect it 

Generally, you may browse the SayHey website (“Site”) without providing any Personal  Information. For Users, certain information such as email address, first name and surname,  username and password, and possibly information related to the User’s job (such as title) and  phone numbers may be required to allow a User to interact with the Application or to set up the  service. As a function of the Application, Users may submit information to us to use the  Application.  

The SayHey service may also collect non-personally identifiable information. In order for your  administrator to track analytics on users of the Service, the admin may turn on analytics to capture logs, metrics and other device and technical data to understand how its users use the service.  This may include information such as your web request, Internet Protocol address, device  identifiers, device information (such as OS type or browser type) and settings, pages viewed,  crash data, and other similar technical data. We may use third party tools and analytical services  to gather and analyze this information. 

The Site and Application are not intended for children under 16 years of age. No one under age  16 may provide any information to us through the Application or the Site. We do not knowingly  collect Personal Information from children under 16. If you are under 16, do not access, use, or provide any information on the Site or on or through any of its features. If we learn we have  collected or received Personal Information from a child under 16 without parental consent, we will  delete that information. 

  1. How we use information 

We do not sell your Personal Information to third parties. We will share your Personal Information  with third parties only as described in this Privacy Policy. We may provide your Personal  Information to companies that provide services to help us with our business activities such as  sending invoices, payment processing, or offering customer service. These companies are  authorized to use your Personal Information only as necessary to provide these services to us.  SayHey may share information with corporate affiliates such as parent or subsidiary  organizations. A list of all subprocessors and corporate affiliates is available here. 7T does not  access Personal Information in user account data except as may be requested during a support  ticket or as required by law.  

We may also disclose your Personal Information as required by law such as to comply with a  subpoena or similar legal process when we believe in good faith that disclosure is necessary to  protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a  government request. 

We may use the Personal Information collected to contact you about the website, notify you about  changes to the Website or the Services, evaluate services we could (or do) offer you, monitor or  improve the Services, customize the content you see on the website, or send you promotional  material. 

As a key feature of using the Site and Application is interacting with others, User information may  be available to other users. In addition, the content provided to the Application by Users is out of  7T’s control. Admin settings may control the level of access or the method by which users may  be contacted by other users. Users, and other Customer representatives and personnel may be  able to access, modify, or restrict access to information. Your employer may, for example, be able  to use features of the Application to access or modify your profile details, or to export logs of User  activity. Customer is responsible for what Customer’s Users or other third party products do with  Customer Data and any Personal Information contained in Customer Data. 

  1. Third Party Applications 

If and to the extent the Customer Administrator permits third party applications, 7T may send or  receive data to support the functionality with such third party applications. Such third party may  share information about customer’s interaction with SayHey and the third party’s application.  When the customer or User provides consent via their device or integration, contact information  provided by Users may be sent to the SayHey Application. Customer and Users are not obligated  to provide content or Personal Information to SayHey, but not doing so may prevent SayHey from  providing the Application services, such as setting up User accounts. 

  1. Legal Bases for Processing 

7T ey relies on its legitimate interests in (a) providing, maintaining, updating and protecting its  Site, Application and business, (b) providing the most useful services as possible to support  customer’s productivity including communicating with and responding to customer requests, and (c) preventing security issues as its legal bases for processing customer and Personal Information in accordance with the Terms. We may use contact information for managing the parties’ obligations, such as billing and account management.  

In addition, SayHey will follow Customer’s instructions regarding User information as indicated in  the Terms; display User-provided information as a core function of the Application; allow  Customer administrators to enable controls of the Application; work with third party providers of  complimentary functionality to enrich the usefulness of the Application; share information as  legally required such as in the event of a confidential transaction or reorganization of its business,  to protect its rights or or to comply with laws or law enforcement or regulatory obligations; or with  consent consistent with this Privacy Policy. 

  1. Cookies 

A cookie is a piece of data stored on a site visitor’s hard drive or device to help us improve your  access to our site and identify repeat visitors to our site. Cookies are not used in the SayHey  Service. Some of our business partners may use cookies but we do not control or access these  cookies. Generally your web browser should provide you with the controls to manage and delete  cookies from your device; please see your web browser options. 

  1. Opting Out of Communications 

If you would like to stop receiving email communications from SayHey, you may disable this  functionality in the service. The communications you receive from SayHey are based on settings  in your service. Please contact your SayHey administrator if you need assistance in disabling  these communications.  

  1. Security 

SayHey takes data security seriously and works to protect data you provide from loss, misuse,  and unauthorized access or disclosure. Do not share your password or give another user access  to your account. Please report any security issues or suspected security issues to your SayHey  administrator or support@sayheymessenger.co. Given the nature of communications and  information processing technology, no company can guarantee that information during  transmission through the Internet or while stored on our systems or otherwise in our care will be  absolutely safe from intrusion by others. When you click a link to a third-party site, you will be  leaving our site and we don’t control or endorse what is on third-party sites. 

  1. Updates to this Policy 

We may update this Privacy Policy statement to reflect changes to our privacy practices or  changes to laws, international treaties, or industry practices. We encourage you to periodically  review this page for the latest information on our privacy practices. If we make changes that  materially alter your privacy rights, we will provide additional notice, such as via email or through  the SayHey Service. If you disagree with the changes to this Privacy Policy, you should deactivate  your SayHey account. Contact the Customer SayHey administrator if you wish to request the  removal of Personal Data under their control. 

  1. Data Retention

SayHey may store archived copes of the data following the end of a subscription term for the  requisite time to support its legitimate business interests, conduct audits, comply with (and  demonstrate compliance with) legal obligations, resolve disputes, and enforce our agreements. 

  1. Global Practices 

Due to the global nature of the economy and the SayHey Application, SayHey may transfer your  Personal Data to countries other than the one in which you live, including transfers to the United  States, where we are based. SayHey will comply with the requirements of the applicable laws in  the respective jurisdiction in line with its obligations relating to such transfer as set forth in the  Terms. 

  1. Data Controller and Processor 

In general, the customer that entered an Order Form with SayHey is the controller of all the data  entered into the SayHey Service. In general, SayHey is the processor of such data and the  controller of the other information.  

  1. California Privacy Rights 

For California residents, under California law, specifically the California Consumer Privacy Act or  “CCPA,” as amended by the California Privacy Rights Act or “CPRA,” we must spell out the  categories of personal information that collect and for what business purposes, much like detailed  above. We collect the following categories of personal information from individual Users, the  Customer, and third-party providers for our business purposes: 

  • Contact information; 
  • Professional or employment-related information; 
  • Audio and visual and text data submitted to the Service (to the submitted by Users, but  not requested or required by SayHey). 

We share this information as described above. SayHey does not sell (as such term is defined in  the CCPA or otherwise) the personal information we collect and will not sell it without providing a  right to opt out, as required by law. Where we work with third parties, so do not allow them to  independently collect personal information from our Service, and any access to information we  provided is limited to the specific and limited purpose for which we use such provider.  

The CCPA provides California consumers the right to request more details about the categories  or specific pieces of personal information we collect (including how we use, disclose, or may sell  this information), to delete their personal information, to opt out of any “sales”, to know about and  opt out of sharing of personal information for delivering advertisements on third-party websites,  and to not be discriminated against for exercising these rights. 

To exercise rights under CCPA, California consumers may send a request to us  at support@sayheymessenger.co. To the extent we have any such personal information, we will  verify your request using the information associated with your account, including email address. Government identification may be required. Consumers can also designate an authorized agent  to exercise these rights on their behalf. Authorized agents must submit proof of authorization.

Where a user has the right to request access to personal information, as well as to seek to update,  delete, or correct this information, you can do this using the settings and tools provided in your  User account. If you cannot access the information using the settings and tools, contact the  Customer Administrator who controls your SayHey instance for assistance.

SayHey Subprocessors 

The SayHey Messenger Application uses third parties to directly and indirectly support the  delivery of the SayHey Services. The provider of SayHey, 7T, maintains this list of  subprocessors that may process personal data on its behalf. Personal data may be shared with  subprocessors but only to the extent necessary to provide our Services or to support our  internal processes. This list provides information about these subprocessors. 7T reviews the  data protection and security practices of all subprocessors and requires each to confirm it will  uphold its obligations in this regard. 

To support evolution of SayHey messenger, these subprocessors may change over time. The data transfer mechanisms for each subprocessor will be reviewed prior to engaging new  subprocessors. To be notified of updates to this subprocessor list, please use this link to add a  subscription to your RSS feed reader. Otherwise, please check back here regularly. 

Upon notice of a new SayHey subprocessor, a customer may object to SayHey’s use of such  subprocessor by sending an email to support@sayheymessenger.co within five (5) business days  from the date such new subprocessor is posted or notification of a new subprocessor is provided.  

Where possible, SayHey will use reasonable efforts to make available to the customer a change  in the provision of the Service to avoid processing of personal data by the objected-to new  subprocessor without unreasonably burdening the Customer provided the objection is  reasonable. If SayHey is unable to accommodate a change within a reasonable period of time  (at least thirty days), the Customer may terminate the applicable Order Form(s) with respect only  to those Service(s) which cannot be provided by SayHey without the use of the objected-to new  subprocessor by providing 30 days prior written notice to SayHey.
