Acceptable Use Policy

This Acceptable Use Policy ( “AUP”) sets forth the acceptable and unacceptable conduct for using our Services, and protects the interests of all of our customers, as well as our goodwill and  reputation. This AUP is so important that we cannot provide the Service unless you agree to them.  Every customer of ours agrees to abide by this AUP and is responsible for any violations. By using  the 7T Service, you are agreeing to these terms.  

You are not allowed to assist or engage others in a way that would violate this AUP. If you cannot  comply with the AUP, you may not use the Services. 

Capitalized words that are used but not defined in this Policy have the definitions provided in the  Terms. You may not use the Subscription Service if you are legally prohibited from receiving or  using the Subscription Service under the laws of the country in which you are resident or from  which you access or use the Subscription Service. This policy may change, so please check back  regularly for updates and changes. You agree to review the AUP on a regular basis and always  remain in compliance. When we change this AUP, the “Last Modified” date above will be updated  to reflect the date of the most recent version. 

  1. Prohibited and Unauthorized Uses of the Services 

By using the Services, you agree that you will not misuse the Services or assist any other person to do so. You may not do or attempt to do any of the following in connection with the Services.  This list of prohibitions provides examples of prohibited conduct, and is not intended to be a  complete or exclusive list of all prohibitions. Users may not: 

1.1 launch any automated system, including, “robots,” “spiders,” or “offline readers,” that sends  more request messages to our servers in a given period of time than a human can  reasonably produce in the same period by using a conventional browser; 

1.2 use the Subscription Service in any manner that could damage, disable, overburden, impair,  interfere with or disrupt the Services, host, system or network connected to the Services,  including, without limitation, overloading, flooding, spamming or mail bombing any part of the Services, or by using any type of spider, virus, worm, trojan-horse, time bomb or any other  codes or instructions that are designed to distort, delete, damage or disassemble the  Services, computer software or hardware, or telecommunication equipment; 

1.3 attempt to gain unauthorized access to the Subscription Services or any User account;  

1.4 access the Subscription Service other than through our interface computer systems or  networks connected to the Services, through password mining or any other means; 

1.5 probe, scan or test the vulnerability of any system or network connected to the Services; 

1.6 attempt to bypass or break any security mechanism on any of the Services or circumvent  any limits imposed on the Service or inherent in the applicable subscription plan or feature  purchase, including number of Users, storage limits; 

1.7 use the Subscription Service for any purpose or in any manner that is unlawful or prohibited  by this Agreement, including permitting use by children under 16 years of age or use of any  data for which Customer does not have appropriate rights or consent;

1.8 copy, modify, disassemble, reverse engineer, decompile, or otherwise attempt to derive  source code from the Services in whole or in part; 

1.9 reproduce, sell, or distribute the Services to third parties for any purpose other than the  internal business purposes of the Customer that purchased such Services, unless  specifically authorized as a reseller or distributor by 7T under a separate written agreement; 

1.10 modify, adapt, or create derivative works based on the Services; 

1.11 re-license, sublicense or offer or use the Services on a timeshare or service bureau basis,  or on behalf of a third party, or use the Services for the development, production or  marketing of a service or product substantially similar to the Services; 

1.12 violate the law, including storing, publishing or sharing material or information that is  fraudulent, defamatory, libelous or misleading, or is otherwise malicious or harmful or  unlawfully discriminatory to any person or entity;  

1.13 upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of 7T’s or any third party’s equipment; or 

1.14 use the Services for consumer purposes, as 7T products are intended for use by businesses  and organizations. 

  1. Sensitive or Regulated Customer Data 

The SayHey Subscription Service is not designed to comply with all industry-specific regulations  such as, but not limited to, Payment Card Industry Data Security Standards, the Gramm-Leach Bliley Act (GLBA), the Federal Information Security Management Act (FISMA), the Canada’s  Personal Information Protection and Electronic Documents Act (PIPEDA) (S.C. 2000, c. 5), and/or  any regulations having the force of law or laws in force in pertaining to the Customer Data to be  processed through the Application. You may not use the Subscription Service where your  Customer Data would violate such laws, unless otherwise agreed in an Order Form. YOU AGREE  NOT TO USE THE SUBSCRIPTION SERVICE TO COLLECT, MANAGE OR PROCESS  SENSITIVE INFORMATION UNLESS SPECIFICALLY IDENTIFIED AND AGREED IN AN  ORDER FORM. WE WILL NOT HAVE ANY LIABILITY THAT MAY RESULT FROM YOUR USE  OF THE SUBSCRIPTION SERVICE TO COLLECT OR MANAGE SENSITIVE INFORMATION. 

As it pertains to Customer Data, Customer is responsible for compliance with the General Data  Protection Regulation (2016/679), the Directive 2000/31/EC of the European Parliament and  Council of 8 June 2000, on certain legal aspects of information society services, in particular,  electronic commerce in the Internal Market, along with the Directive 2002/58/EC of the European  Parliament and Council of 12 July 2002, concerning the processing of personal data and the  protection of privacy in the electronic communications sector. 

  1. Violations 

7T reserves the right to investigate anyone who, in 7T’s sole discretion, is suspected of violating  this AUP and take any action it deems appropriate, including but not limited to contacting law  enforcement authorities, blocking or removing Customer Data believed to be in violation,  temporarily or permanently disabling a user’s access to the Service, and terminating or  suspending a user and blocking their access to the Service. In addition, 7T reserves the right to  exercise whatever means it deems necessary to prevent unauthorized access to or use of the  Services, including, but not limited to, implementing technological barriers, IP mapping, and direct contact with an unauthorized user’s internet service provider. 7T’s failure to enforce this AUP in  each and every instance in which it might have application does not amount to a waiver of 7T’s rights hereunder.
